Bali, Indonesia, WORLD.WARTAGLOBAL.id - The widespread trend of making foreigners go viral on social media has become a hot topic, but this practice is illegal and has negative consequences, especially for underage individuals. The Head of Public Relations of the Bali Regional Police, Commissioner Pol Satake Bayu S.I.K., M.Si., clarified a news report regarding the viralization of foreign tourists' actions in Bali, which could lead to violations of the Information and Electronic Transactions Law (UU. ITE), on Monday (May 29, 2023).


The viralization of social media content related to foreigners needs clarification regarding the statement made by the Chief of Police in Bali. We want to emphasize that intentionally or unintentionally spreading pornographic videos and acts of pornography on social media platforms is what is being addressed. For example, a viral video of a foreigner without clothing (naked) appearing during a Balinese dance performance at Puri Saraswati Ubud, or viral videos of foreigners engaging in indecent acts by the pool, as well as videos containing explicit pornography and other acts, can be subject to criminal charges under the UU. ITE.


The appeal made by the Bali Police Chief, Inspector General Putu Jayan Danu Putra, is based on a solid foundation. It aims to encourage the public to be courteous when using social media, advising against viralizing content related to pornography and indecent acts. Apart from violating the UU. ITE, such content can also have a detrimental impact on the psychological well-being of viewers, especially underage children.


The UU. ITE also regulates matters of morality, gambling, defamation or insults, threats and extortion, as well as fraud (illegal access), all of which exploit social media platforms.


However, there are certain types of content that can be viralized to serve the purpose of public oversight, without any issues arising from the UU. ITE. For example, issues within the community that require special attention from the police or the government, such as corruption, gambling, damaged roads or schools, extortion, disturbances to public order, or other forms of injustice.


Specifically regarding pornography and indecent acts, the UU. ITE has established that those who create and distribute videos can be subject to criminal penalties.


Therefore, if any member of the public becomes aware of instances involving pornography, indecent acts, or other forms of immorality, they should report the matter directly without resorting to viralization. The laws in Indonesia address these issues through the Indonesian Penal Code (KUHP), the Pornography Law, and the Child Protection Law.
