Ditreskrimsus of the Bali Regional Police uncovers Human Trafficking Case.

WORLD.WARTAGLOBAL.id - Ditreskrimsus (Directorate of Criminal Investigation) of the Bali Regional Police has revealed the involvement of three perpetrators in a Human Trafficking case (TPPO). This was revealed during a press conference held at the Ditreskrimsus Building of the Bali Regional Police in Denpasar, attended by the Head of Public Relations of the Bali Regional Police, Commissioner Pol. Satake Bayu, along with the Deputy Director of Ditreskrimsus of the Bali Regional Police, AKBP Ranefli Dian Candra, and the Head of Subdivision of Public Information (Bidhumas), AKBP Ketut Eka Jaya, on Tuesday (20/6/2023).


The three suspects involved in the TPPO case are M. Akbar Gusmawan (34 years old), the manager of MAG Diamond agency (PT. Mutiara Abadi Gusmawan), Agus Kusmanto, and Elly Yulianthini, a married couple who are the owners of Diah Wisata Foundation.


The suspects deceived their victims by recruiting prospective Indonesian migrant workers (PMI) and promising to send and place them in Japan without having the Indonesian Migrant Worker Placement Permit (SIP2MI).


Deputy Director of Ditreskrimsus of the Bali Regional Police, AKBP Ranefli Dian Candra, explained the chronology of the events. On November 29, 2021, the informant became aware of the MAG Diamond agency (PT. Mutiara Abadi Gusmawan) and planned to register as an Indonesian Migrant Worker (TKI) to go to Japan.


"The informant received the requirements from the company named PT. Mutiara Abadi Gusmawan. Subsequently, the informant was asked to make a payment of IDR 35,000,000 (thirty-five million rupiahs). After making the payment, the informant received training from the company for three months at STIKOM Bali campus in Renon. After completing the training, the informant also applied for a Visa at the training location," said AKBP Ranefli.


"The informant has also signed a contract contained within the form/employment contract and was promised a salary of USD 4500 and was scheduled to depart for Japan on August 30, 2022. However, until now, the informant and others have not been sent. The informant received information from fellow informants that PT. Mutiara Abadi Gusmawan sent Indonesian Migrant Workers to Malaysia with Holiday Visas," he continued.


"PUTU WINARTI (still in Malaysia) and DWI LANTARI (returned by immigration) were sent to Malaysia with Holiday Visas. After that, the informant was also offered to become an Indonesian Migrant Worker in Malaysia, but the informant did not intend to join because of the Holiday Visa. It turned out that some of the informant's friends had already gone to Malaysia, and several of them were returned by immigration and were not given their salaries. Following this incident, a more in-depth investigation was conducted to determine the existence of criminal acts," concluded AKBP Ranefli.



The number of victims from the Diah Wisata Foundation is approximately 30 people, with each candidate PMI paying IDR 35,000,000 for their departure to Turkey and IDR 75,000,000 for their departure to New Zealand. The total amount of money received by Elly Yulianthini from the foundation is approximately IDR 2,000,000,000 (two billion rupiahs), which has been handed over to PT. Mega Angkasa and PT. Arin Anugerah for approximately IDR 1,600,000,000 (one billion six hundred million rupiahs). So far, five individuals have reported their cases, while approximately 25 individuals have not yet come forward.


Meanwhile, the number of victims associated with the MAG Diamond agency (PT. Mutiara Abadi Gusmawan) is estimated to be between 280 and 290 individuals. Seventeen victims have already filed reports, while around 283 individuals have yet to report their cases.



The candidates or prospective PMI paid a departure fee ranging from IDR 25,000,000 to IDR 35,000,000. The total amount of money received by PT. Mutiara Bali Gusmawan is approximately IDR 3,600,000,000 (three billion six hundred million rupiahs). However, this sum has been transferred to GINA AGOYLO CRUZ through transactions from the company's account to Ms. GINA's May Bank account. The exact amount of money received directly by GINA AGOYLO CRUZ from the candidates' payments is unknown as GINA AGOYLO CRUZ is currently on the wanted list. Seventeen victims have reported their cases, while approximately 283 individuals have not yet come forward.


Commissioner Pol. Satake Bayu Bali, the Head of Public Relations of the Bali Regional Police, took this opportunity to urge the public to be cautious when accepting job offers abroad. He advised not to easily believe promises of high salaries, bonuses, or all-inclusive facilities, including the recruitment and placement process, from recruiters or labor providers.



In this TPPO case, the suspects are charged under Article 86 letter c, in conjunction with Article 72 letter c of the Indonesian Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers, in conjunction with Article 55 paragraph (1) clause 1 of the Indonesian Penal Code (KUHP). They are also charged under Article 87 paragraph (1) in conjunction with Article 72 letter c of the Indonesian Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers, in conjunction with Article 55 paragraph (1) clause 1 of the Indonesian Penal Code (KUHP). Additionally, they face charges under Article 2 of the Indonesian Law Number 21 of 2007 concerning the Eradication of Human Trafficking, in conjunction with Article 55 paragraph (1) clause 1 of the Indonesian Penal Code (KUHP), as well as under Article 4 of the Indonesian Law Number 21 of 2007 concerning the Eradication of Human Trafficking, in conjunction with Article 55 paragraph (1) clause 1 of the Indonesian Penal Code (KUHP). They may also be charged under Article 11 or Article 15 paragraph (1) of the Indonesian Law Number 21 of 2007 concerning the Eradication of Human Trafficking, in conjunction with Article 55 paragraph (1) clause 1 of the Indonesian Penal Code (KUHP).
