Circulation of Fake Immigration Stamps in Foreign National Passports, Report to Bali Police

It is regrettable that Immigration Officers are suspected of playing with stamps on foreign nationals.
The day before VM was visited by immigration officers, Samuel, VM's attorney from Fanisa Wilson Law Firm had sent a warning letter to the person suspected of being involved in the alleged crime of falsifying authentic documents (PMA).

Detaining the passport of a foreign citizen (WNA) without a legal basis is an act that violates human rights and international law. Where a passport is an official document issued by the country of origin of the WNA and is owned by that country. Detaining a person's passport without a valid basis can be considered an abuse of authority and a violation of the individual's right to move freely.

Detaining a passport without a strong reason can involve violations of the law in the local country and international law, and can potentially trigger diplomatic problems between countries. Usually, a passport can only be withheld if a person is facing legal proceedings, deportation, or other actions regulated by clear law.

The Attorney explained the chronology:
That when our client was in Bali, Indonesia arrived on September 18, 2024, and on October 21, 2024, our client was suddenly arrested in the Canggu area and taken by a person who claimed to be an immigration officer named Jesaja Samuel Enock.

After our client was successfully taken to the Immigration Service Office at the Bali Ministry of Law and Human Rights Regional Office in Renon, without an arrest warrant and or any warrant.

1. Our client was examined at around 21.00 WITA, and our client only received a summons and a receipt for the surrender of the passport when he arrived at the Ministry of Law and Human Rights Regional Office. After the interview examination that night, our client was asked to come back on October 22, 2024 at 13.00 WITA;

2. That on October 22, 2024, Our Client underwent an examination at the Immigration Room of the Bali KemenkumHAM Regional Office, Our Client was shown a RE-ENTRY PERMIT NOT TO RETURN NO. REG: 2G34E10725-A, issued by Mr. Cahyo Yudistiro, A.md.Im., S.H., M.M. dated July 23, 2024, the document was shown by an official named Setyo Budiwardoyo together with an official named Jesaja Samuel Enock, 3. then it was said by the officials who examined our client, because of the existence of the document, Our Client's immigration document became invalid, Our Client was declared to be in Indonesian territory ILLEGALLY, and the September 18 Airport Passport stamp was considered Fake and INVALID. even though Our Client did not have any problems upon arrival and inspection at I Gst Airport. Ngurah Rai, Bali,
the examination also ended at around 17.30 WITA, but our client's passport was still being held by the person conducting the examination that day and did not sign any investigation or interview files;

4. That we were asked to come back on Monday, October 28, 2024 at 14.00 WITA, and the examination was continued until 17.00 WITA. We also found irregularities in the initial investigation stage, the officer who examined at that time, Mr. Jesaja Samuel Enock, did not show an investigation warrant and a task order for our client as stipulated in Article 24 of the Regulation of the Minister of Law and Human Rights Number 39 of 2021 concerning Procedures for Investigation of Immigration Crimes. At the end of the examination session, our client still did not get any clarity on the basis of the error or the basis for the detention of our client's passport, so that due to these irregularities, it can be suspected that there was an error in the examination procedure or efforts by certain parties to have our client deported so that he was hindered in the police examination of the alleged criminal act of forgery which was being reported by our client at the Bali Police Headquarters on October 23, 2024;

5. That our client is currently in the status of reporting his business partner on suspicion of forgery of letters as referred to in Articles 263, 264 and/or 266 of the Criminal Code at the Bali Police, as stated in the Report Receipt Letter Number: 734/X/2024/SPKT/POLDA BALI, dated ... Based on the description of the incident, we request the Head of the Bali Regional Office of the Ministry of Law and Human Rights to:

1. Provide a sense of security and obtain a sense of justice for our client who is currently complaining
or the alleged criminal act of forgery at the Bali Police, in order to avoid efforts that cause our client to be obstructed in the reporting process at the Bali Police;

2. Order the Investigator or Official handling our client's case to be able to show the warrant and/or assignment letter in the case of examining our client and to describe the alleged violations committed by our client and the reasons accompanied by the legal basis for the detention of our client's passport;

3. Order the Investigator or official examining our client to issue a summons through a summons as stipulated in Article 104 of Law No. 6 of 2011 concerning Immigration in conjunction with Article 112 of Law No. 8 of 1981 concerning Criminal Procedure Code (KUHAP) when re-examining our client;

4. Order the Investigator or Official who is currently holding our client's passport, to return our client's passport as soon as possible, if from the results of the examination on October 21, 22 and 28, 2024, no indications of violations were found by our client;

"What makes me even more confused is information from Mr. Jesaja Samuel Enock. The ERP date keeps changing."

My question is, if the ERP really exists, then on September 18 when our client arrived here, a VOA should have been given at the airport. So who was negligent in giving a residence permit??? Can foreign nationals who arrive at the airport provide their own immigration stamps at the airport?? It turns out that the supervision at the airport is indirectly not strict?? Aka fake.
