BALI — The business and investment sector in Bali requires robust legal protection, particularly in anticipating and resolving commercial disputes. Based on a presentation by prominent legal and arbitration expert, Prof. Dr. Insul Indrawan, S.H., M.H., M.M., Ph.D., et al., it was emphasized that proper dispute resolution mechanisms serve as a crucial foundation for the long-term sustainability of any business entity.

The presentation highlighted that pursuing litigation (court) often triggers prolonged uncertainty, high costs, and potential damage to commercial relationships, as disputing parties generally both suffer losses with no absolute winner. Therefore, alternative
dispute resolution through mediation or arbitration (such as through the Indonesian National Arbitration Board / BANI) offers a more flexible, confidential, and efficient approach.
As an anticipatory measure, business players are strongly advised to explicitly include clear arbitration clauses in their cooperation contracts from the outset. This aims to ensure legal certainty and maintain long-term partnerships among parties should any issues arise in the future.
