Bali Developers Demand Immediate Arrest of Budiman Tiang as Supreme Court Fraud Verdict Ignored for Third Time

BADUNG, BALI – In a high-stakes press conference held at The Umalas Signature on Tuesday (29/7/2026), the legal teams and boards of directors of PT Samahita Umalas Persada (PT SUP) and PT Magnum Estate International (PT MEI) issued a fierce ultimatum to the Denpasar District Prosecutor's Office: immediately arrest convicted fraudster Budiman Tiang (BT) to execute a final and binding Supreme Court ruling.

The demand comes as the convicted businessman has allegedly snubbed the authorities three times, failing to appear for execution summonses despite the Supreme Court of the Republic of Indonesia (Decision No. 972 K/Pid/2026 dated May 10, 2026) sentencing him to 3 years and 6 months in prison for fraud and embezzlement. Although a foreign travel ban has been officially issued, BT remains at large, prompting developers to accuse prosecutors of dragging their feet.

"Stop the Distortion": Lawyers Slam Misleading Narratives

Lead counsel Dr. Agus Samijaya, S.H., M.H., did not mince words, calling out the "massive distortions" propagated by BT's camp regarding asset ownership, which is solely based on the physical possession of four SHGB certificates.

"We emphasize and hope that the public understands the true legal position concerning the dispute between PT SUP and PT MEI versus Budiman Tiang and his affiliated companies. The distortions have been rampant," Agus stated firmly.

He stressed that the victims are now demanding swift action from the state prosecutors. "As victims of this fraud and embezzlement, we strongly hope that with this inkracht verdict, the Denpasar Prosecutor's Office will immediately carry out the arrest and execute the sentence," he asserted.


The Numbers Don't Lie: Losses Exceed Hundreds of Billions

The financial devastation laid out in the court's findings is staggering. Parede Sitorus, S.H., M.H., Head Legal of Magnum Estate International, meticulously detailed the losses based directly on the public prosecutor's indictment (JPU):

· Embezzlement (Art. 372 of the Criminal Code): PT SUP suffered a verified loss of Rp 179 billion directly caused by Budiman Tiang's actions.
· Illegal KSO Funds: BT is accused of misappropriating Rp 14.6 billion from a cooperation agreement (KSO).
· Asset Seizure: The physical takeover of the building complex has resulted in an additional estimated loss of Rp 207.6 billion in asset value.

"We are referring specifically to the facts established during the trial," Parede confirmed.

Illegal Takeover and Renaming of "The Umalas Signature"

The press conference also exposed BT’s brazen operational takeover. Dimas Roland Jonas Suhartono, S.H., counsel for PT MEI, revealed that BT had forcibly evicted the rightful owners from the premises and rebranded the prestigious The Umalas Signature as The One Umalas.

"BT illegally seized this building by kicking out PT SUP and PT MEI. During his unlawful occupation, he has been leasing out the spaces and pocketing the rental income—ranging from hundreds of millions to billions of rupiah—directly into his personal accounts and those of his affiliates," Dimas alleged.

He added that BT also took Rp 14.6 billion from the KSO funds, further compounding the financial rape of the companies.


The SHGB Saga: A Deposit Turned Hostage

Parede Sitorus clarified the contentious history of the four SHGB certificates (No. 101, 102, 103, and 104/2016), which BT frequently uses as a "legal shield."

BT purchased these certificates in 2016. In 2019, a mutual agreement was struck with business partners (Herman Sugiyarto and Caradias Sulianto) to use the land for the TUS project, with a replacement value of Rp 6.9 billion—which was fully paid in installments by 2021.

To avoid hefty transfer fees and ensure mutual security, all three parties agreed to deposit the physical certificates with Notary I Putu Ngurah Aryana, S.H.

"However, BT forcibly retrieved the certificates from the notary, threatening the notary to hand them over. He took them without the consent of PT Samahita Umalas Persada. How are we supposed to transfer the title if he physically holds the documents and refuses to cooperate?" Parede questioned.


Permit Scandal Debunked: PBG and SLF Fully Legal

Responding to baseless accusations of invalid permits, Dr. Putu Nova Christ Andika Graha Parwata, counsel for PT MEI, provided a technical legal breakdown.

He explained that the Certificate of Feasibility (SLF) issued on August 7, 2022, and the Building Construction Permit (PBG) issued on August 11, 2022, are perfectly legitimate under Article 262 paragraphs (1) and (4) of the building regulations.

"At that time, the agencies handling SLF and PBG were different. The SLF was issued without retribution, while the PBG was issued four days later because we paid the fee. Both were based on clear administrative requirements," Putu Nova explained.

He emphasized that the government issued these permits correctly. "We are fighting for truth and justice. We are defending those who followed proper administrative procedures."

Furthermore, the legal counter-attacks by BT's camp have been an utter failure in court. All three civil lawsuits filed by BT—including a breach of contract suit (No. 805/Pdt.G/2025/PN Dps), a Rp 14 billion debt claim (No. 1266/Pdt.G/2025/PN Dps), and a financial audit request (No. 187/Pdt.P/2025/PN Dps)—were all declared inadmissible (Niet Ontvankelijke Verklaard / NO) by the Denpasar District Court.

"We are here to protect our rights and safeguard the investment climate in Bali. The law must be enforced," Charles stated.
